Rush Limbaugh attacked President Obama’s nomination of Elena Kagan for the Supreme Court, calling her a “liberal elitist” who is unqualified for the court and has no clue about how ordinary Americans live.
The conservative radio talk show host on Monday also dismissed suggestions that Kagan, who served in the Clinton administration, is sympathetic to the right and could move the court in that direction.
“If the regime really thought she was open-minded, thought she was sympathetic to conservatives and their point of view, they never would have let her be nominated,” he said.
“It’s all a crock. If they had the slightest doubt of her far-left credentials, she would never have been nominated.”
Referring to Harriet Miers, the George W. Bush court nominee who withdrew her name when Democrats and Republicans objected to her lack of credentials, Limbaugh said about Kagan: “We don’t know anything about her. This woman is worse than Harriet Miers. Intellectually, she’s a lightweight.”
Noting that Kagan idolized Supreme Court Justice Thurgood Marshall — she was a law clerk for Marshall — Limbaugh pointed out that, in a 1976 speech, Marshall “declared, according to a law review article she wrote, that the Constitution as originally drafted and conceived was defective. Only over the course of 200 years had the nation attained the system of constitutional government and its respect for individual freedoms and human rights that we hold as fundamental today.
“The Constitution today, the justice continued, has a great deal to be proud of. But the credit does not belong to the framers, it belongs to those who refused to acquiesce to outdated notions of liberty, justice and equality and who strived to better them.”
Rush continued: “The credit, in other words, belongs to people like Justice Marshall. So this is who Elena Kagan idolizes.”
Limbaugh also asserted that liberals never will object seriously “to her not being qualified. The only qualification is that you be liberal and believe the Supreme Court is to rewrite the Constitution. If you believe the Constitution is outdated and no longer serves a purpose, like Thurgood Marshall thought, that’s all the qualification you need.”
Limbaugh said he thinks Kagan plays basketball and referred to rumors that she smokes, adding that she is a “mirror image of Obama.”
Citing her upbringing on Manhattan’s Upper West Side and a life spent in academia, including as dean of Harvard Law School, Limbaugh said: “As is the case with all liberal elitist theoreticians, they have no clue how real Americans live. They think they know how Americans ought to live, and that is what they want to use the judiciary for.”
